Ish terms of use
These terms cover your use of Ish, the drawing game made by NEXTGEN SOFTWARE LTD (“we”, “us”), a company registered in England and Wales. By downloading or playing Ish you agree to them. If you don’t agree, please don’t use the app.
01 Apple’s licence
You get Ish from the App Store, so Apple’s Standard Licensed Application End User License Agreement (opens in a new tab) applies to it. These terms add to that agreement. If the two disagree about your licence to use the app, Apple’s agreement wins.
Apple isn’t a party to these terms and isn’t responsible for Ish, its content or its support. That’s us.
02 The game
Ish is free to play and paid for by ads. We may add, change or remove features, items and modes, and we may stop running the game, though we’ll try to give notice before we do.
Daily rankings, streaks, scores and stickers are for fun. They have no cash value and there are no prizes.
03 Your player
You don’t need an account. The app makes an anonymous player for you, with a name picked at random. Your progress lives on your phone, so deleting the app starts you afresh.
04 Playing fair
Please don’t:
- cheat, or send results the game didn’t produce, for example by tampering with the app or its traffic;
- copy, change, decompile or reverse engineer the app, except where the law allows it;
- use bots, scripts or anything else automated with the game or its servers;
- try to get into data or systems that aren’t yours, or overload or disrupt the game;
- use Ish for anything unlawful.
If you do, we may remove your results from the rankings or stop your player from sending results.
05 Your drawings
Your drawings are yours. For Daily rounds the app sends us your drawing with your result. You give us permission to store it and use it to run the game, check results, and improve how drawings are scored. We never show your drawings to other players and we never sell them. The privacy policy explains what else we collect.
When you share a result card, you choose where it goes. Please don’t share it anywhere that would break that place’s rules.
06 Ads
Ads come from Google AdMob and its advertisers. We aren’t responsible for what advertisers say or sell, or for their apps and websites. Optional rewarded ads give you a hint while you draw in Endless, a peek at an answer, or another go at the Daily. If an ad fails to load, you may not get the reward, and there’s nothing to refund.
07 Our content
The app, its name, artwork and code belong to us or the people who license them to us. Country outlines come from Natural Earth (opens in a new tab), which is in the public domain. We drew the flags ourselves. You may share screenshots and result cards from the game for personal, non-commercial use.
08 The game as it is
We work hard to keep Ish running and accurate, but we provide it “as is”. We can’t promise it’ll always be available, free of bugs, or that a country’s outline or a flag matches every official version. Borders and names in the game aren’t a statement on any territorial or political question.
09 Our liability
Nothing in these terms limits liability that can’t be limited by law, such as for death or personal injury caused by negligence, or for fraud. Your legal rights as a consumer aren’t affected.
Otherwise, we aren’t liable for losses that weren’t foreseeable, for lost progress, or for business losses. Ish is for personal, non-commercial use. Since the game is free, our total liability to you is limited to £50.
10 Ending
You can stop at any time by deleting the app. To have your data deleted too, use Settings → Delete my data in the app first; delete your data explains what it removes. We may stop your player from sending results if you break these terms.
11 Changes to these terms
We may update these terms, for example when the game changes or the law does. We’ll update this page and the date at the top. If you keep playing after a change, the new terms apply.
12 Law
These terms are governed by the laws of England and Wales, and the courts of England and Wales deal with any dispute. If you live in Scotland, Northern Ireland or the EU, you can also use your local courts, and your local consumer law still protects you.
